A 26-Year-Old Palm Coast Man Is Arrested On 3 Counts of Lewd Sex With 14 Year Old

Javon Hall, a 27-year-old resident of Whispering Pine Drive in Palm Coast, is in jail on $100,000 bond following his arrest on three charges that he had sex with a 14-year-old Palm Coast girl. He was arrested Tuesday in Jacksonville by the Jacksonville Police Department and booked at the jail there before his extradition to Flagler County today.

According to Hall’s arrest report, the victim was brought to a forensic interviewer with the Child Protection Team on Aug. 8, when she said that she “did things with a 26-year-old.” She had met Hall through his cousin, at first becoming friends. Hall is married, but separated from his wife. The victim told child protection that he knew she was 14 because she’d told him. She said the relationship entailed consensual sex for 11 months, including six instances of oral sex (two of which with a condom), one of them the day she snuck out of her house on her birthday and walked over to his house. The victim told the child protection interviewer that it was “both their ideas,” according to the report.

The report goes to some length detailing the nature of the encounters, which allegedly took place about 30 times beginning last Oct. 31. When the victim snuck out of her house, Hall let her into his house through the back door, even as his parents were sleeping. They went to his room. The victim, according to the report, “said that she and Javon Hall argued at first because of her jealousy and then they laid together and almost fell asleep, but they started kissing and it led to intercourse.”

The last encounter took place on July 2, according to the victim.


On Sept. 7, Hall was summoned to the sheriff’s office for an interview. He acknowledged having a relationship with the victim, but said there’d been nothing sexual about it. He told the investigator that the victim had been at his house and in his bedroom “because she would be out walking around and he told her to go home and she would say no,” according to the report. Hall told the investigator that “he has a fear of girls walking around at night.” Hall said the victim would also ask him to take him to school. At first, he said, he’d refuse, but then comply. He repeatedly told the interviewer that he “cares a lot” about the victim and that “he doesn’t want anything to happen to her,” suggesting that at that point in his interview, Hall thought the victim was in trouble.

He then ended the interview with the investigator because he had to go to work.

Flagler County Sheriff’s detectives spent more than two months investigating the case before filing the charges–three counts of lewd and lascivious molestation on a victim between 12 and 16 years of age –which were signed by Circuit Court Judge Dennis Craig on September 21.

Under the law, “neither the victim’s lack of chastity nor the victim’s consent is a defense to the crimes” stated. The second-degree felonies are punishable by up to 15 years in prison.

Detectives are asking anyone else may have been victimized by Hall to contact Detective Roger Spires at (386) 586-4801.

 

Relevant Florida Law: 800.04 Lewd or lascivious offenses committed upon or in the presence of persons less than 16 years of age.—

(1) DEFINITIONS.—As used in this section:

(a) “Sexual activity” means the oral, anal, or vaginal penetration by, or union with, the sexual organ of another or the anal or vaginal penetration of another by any other object; however, sexual activity does not include an act done for a bona fide medical purpose.
(b) “Consent” means intelligent, knowing, and voluntary consent, and does not include submission by coercion.
(c) “Coercion” means the use of exploitation, bribes, threats of force, or intimidation to gain cooperation or compliance.
(d) “Victim” means a person upon whom an offense described in this section was committed or attempted or a person who has reported a violation of this section to a law enforcement officer.
(2) PROHIBITED DEFENSES.—Neither the victim’s lack of chastity nor the victim’s consent is a defense to the crimes proscribed by this section.
(3) IGNORANCE OR BELIEF OF VICTIM’S AGE.—The perpetrator’s ignorance of the victim’s age, the victim’s misrepresentation of his or her age, or the perpetrator’s bona fide belief of the victim’s age cannot be raised as a defense in a prosecution under this section.
(4) LEWD OR LASCIVIOUS BATTERY.—A person who:

(a) Engages in sexual activity with a person 12 years of age or older but less than 16 years of age; or
(b) Encourages, forces, or entices any person less than 16 years of age to engage in sadomasochistic abuse, sexual bestiality, prostitution, or any other act involving sexual activity

commits lewd or lascivious battery, a felony of the second degree, punishable as provided in s.775.082, s. 775.083, or s. 775.084.

(5) LEWD OR LASCIVIOUS MOLESTATION.—

(a) A person who intentionally touches in a lewd or lascivious manner the breasts, genitals, genital area, or buttocks, or the clothing covering them, of a person less than 16 years of age, or forces or entices a person under 16 years of age to so touch the perpetrator, commits lewd or lascivious molestation.
(b) An offender 18 years of age or older who commits lewd or lascivious molestation against a victim less than 12 years of age commits a life felony, punishable as provided in s. 775.082(3)(a)4.
(c)1. An offender less than 18 years of age who commits lewd or lascivious molestation against a victim less than 12 years of age; or
2. An offender 18 years of age or older who commits lewd or lascivious molestation against a victim 12 years of age or older but less than 16 years of age

commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s.775.084.

(d) An offender less than 18 years of age who commits lewd or lascivious molestation against a victim 12 years of age or older but less than 16 years of age commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(6) LEWD OR LASCIVIOUS CONDUCT.—

(a) A person who:

1. Intentionally touches a person under 16 years of age in a lewd or lascivious manner; or
2. Solicits a person under 16 years of age to commit a lewd or lascivious act

commits lewd or lascivious conduct.

(b) An offender 18 years of age or older who commits lewd or lascivious conduct commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(c) An offender less than 18 years of age who commits lewd or lascivious conduct commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(7) LEWD OR LASCIVIOUS EXHIBITION.—

(a) A person who:

1. Intentionally masturbates;
2. Intentionally exposes the genitals in a lewd or lascivious manner; or
3. Intentionally commits any other sexual act that does not involve actual physical or sexual contact with the victim, including, but not limited to, sadomasochistic abuse, sexual bestiality, or the simulation of any act involving sexual activity

in the presence of a victim who is less than 16 years of age, commits lewd or lascivious exhibition.

(b) An offender 18 years of age or older who commits a lewd or lascivious exhibition commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(c) An offender less than 18 years of age who commits a lewd or lascivious exhibition commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(8) EXCEPTION.—A mother’s breastfeeding of her baby does not under any circumstance constitute a violation of this section.

    I do not condone any relationship or sex with a minor at all…but the victim in this story really does not sound much like a victim, sneaking out of her house,her approaching him,giving him consent, where are her parents when this is happening, what he did was wrong, even if she consented to him that does not make it ok by any means,but it just kinda sounds as if she herself is a troublemaker,or did i read this wrong…

    So Sheriff Flemings department got this case on 8/7/2012. Waited 30 days to bring him in for an “interview”; let him walk out so he could go to work and now 50 days (7 WEEKS) they finally have him in custody ?? This is the same Sheriff that is running for another term……..VOTE AGAINST THIS HAPPENING CITIZENS !!!!!!!

    Cultural variance! A fourteen-year-old European would be engaged in a love relationship under these configurations. We all mature and age at different rates. Perhaps a bit of gentle understanding of circumstances might not be the worst idea here. By the way, this young man is not a pedophile; he would be a hebephile or ephebephile. We might begin with getting our brave legislators to get the latest in human psychology, no?

    Magicone – Number 1. the Sheriff’s Office cannot do anything unless charges are brought by her, her parents etc. so maybe just maybe… that could be the reason it took as you say 30 days.. no one reported it… unless you know something else… and Number 2, why is very thing politics.. so you thinkd under another administration would have know something beore hand.. please a crime has been done…a child 14 years old.
