Nearly identical Florida House and Senate bills that would all but eliminate Flagler County government’s authority to regulate vacation rentals are making their way through committees. The Senate bill started as more friendly to local regulations, and one committee approved it unanimously. But amendments have since pared that local regulatory power.

Flagler County commissioners and other local officials heard the sobering conclusions of a seminal beach management study today, and the large costs ahead that will fall on all local governments and residents if the beaches are to be preserved. That money is nowhere in place for now, nor is a management plan.

Facing an ultimatum from the U.S. Army Corps of Engineers, the county will sue two Flagler Beach property owners to secure beachside easements necessary to allow the U.S. Army Corps of Engineers to proceed with a long-delayed dune-rebuilding project along 2.6 miles of beach in the city. The county had been threatening just such action for 15 months, but was hoping to avoid it.

Between logistics and tradition, five of the six members of the Flagler Beach City Commission, including the mayor, are either hesitant or opposed to giving up on July 4 fireworks even if Palm Coast wants to hold them on that day only in alternate years. But officials are also saying the whole discussion may be premature, given the impending disappearance of the Flagler Beach pier for two years, when July 4 fireworks will likely have to be in Palm Coast anyway.

The Flagler County Commission gave the go-ahead today for a $16 million south side library on Commerce Parkway in Bunnell, opposite the future Sheriff’s Operations Center, ending eight years of prevarications. But while several funding options are available, it is still not at all clear how the commission will pay for the 32,000 square foot facility, now slated to open in late 2024.

The Flagler County Commission next week will examine plans for a $14 million, 32,000 square-foot library that’ll also include a conference center and a portion of the building for the county’s Health and Human Services division. But as has been the case since 2014, and absent a surprise, the money for the project may be lacking yet again.

Like most communities across the country, Flagler County this week shattered its weekly covid-infection total, with 1,469, exceeding last week’s record of 1,166, though emergency-care clinics’ numbers suggest that the region is near or at its peak of this latest wave, driven mostly by the astonishingly infectious but less lethal omicron variant.

The U.S. Army Corps of Engineers told Flagler County that it is at risk of losing $17.5 million in federal funds earmarked for a 2.6-mile dunes restoration project in Flagler Beach if the county doesn’t show by early February that it has either acquired three remaining holdouts’ easements or that it will take the owners to court to acquire the easements.

The coronavirus’s omicron variant is far more infectious and less virulent than its predecessors, but it is not the common cold. The Flagler Health Department is reporting covid outbreaks in all sectors–schools, nursing homes, assisted living facilities and the Flagler County jail, and a significant increase in covid-attributed deaths in Flagler County since Christmas. As of Dec. 24, 277 Flagler County residents had died of Covid-19. As of today, 285 have.

For an off-year, 2022 will not be short of elections in Flagler County, starting with elections in Flagler Beach, Bunnell and Beverly Beach on March 8. A combined seven incumbents in the three municipalities are making a play to keep their seats, and absent additional candidates filing to run, Bunnell and Beverly Beach could end up with uncontested elections.

Beverly Beach, which brands itself a “small town with a good heart,” donated $10,000, or 5 percent of its American Rescue Plan allocation, to the Flagler Health Department, with Bob Snyder at the commission meeting to accept the donation Monday evening. The money will be spent on diabetes and other public health initiatives.

Infection numbers are surging across Florida, but in a 50-minute news conference this morning, Gov. Ron DeSantis and Surgeon General Joseph Ladapo not only projected a business-as-usual approach, but said testing protocols will be revised toward less testing, with testing and treatment focused on higher-risk patients, while schools are to remain open and operating under previously relaxed guidelines that de-emphasize quarantines, masking and distancing.

Omicron is here, if not yet in full force, and is up to five times as infectious as the delta variant of Covid-19. But if delta was a hurricane, omicron is shaping up as more of a tropical storm. And the more protected your house is–the more you’ve developed immunity through vaccines, boosters, prior infections–the less likely you are to get sick, let alone get gravely ill or die.

Time after time, Flagler County government has battled with owners of the derelict Country Hearth Inn on Old Dixie Highway to get it repaired, or at least to move it past the eyesore and nuisance stage to something less unattractive–and less attractive to vandals and mischief. Both Chief Mike Tucker’s appointment in summer and, in turn, that of Percy Sayles now, reflects a change in direction for a department that for many years drew its leadership from within. It is also no small thing that Sayles will be the highest appointment of a Black firefighter-paramedic to a leadership position in past or present fire departments in the county–in a profession where the proportion of Blacks is not high.

Long approved for 824 homes, the developers of Eagle Lakes’s next phases are asking for a land-use changes that would allow 1,215 homes on the acreage along Old Kings Road toward the south end of the county. Concerning indicators in Flagler County point to covid case counts creeping back up slowly but steadily, a tripling of covid hospitalizations in the last week, to 10, and the first covid-related death in weeks, to a 76-year-old man, bringing the total number of covid deaths in Flagler to a staggering 277 since the first death was reported in April 2020.

The Flagler County administration issued a tightly argued and at times caustic memo that draws a line between facts and polemics and between legal and speculative arguments in the ongoing debate over school impact fees,. While it corrects the school district  in no uncertain terms on several points of law–or math–it also comes close to ridiculing the Flagler Home Builders Association’s arguments as simplistic. It also appears to forge a way out of the impasse for the County Commission.

The Senate Judiciary Committee voted 7-4 to back the proposal (SB 620), which would allow businesses to sue if local ordinances cause at least 15 percent losses of revenue or profits. The bill, sponsored by Sen. Travis Hutson, the St. Augustine Republican who represents Flagler, would apply to businesses that have been operating for at least three years.

A slew of federal subsidies, including Covid-relief funds and an auction with broadband providers, is making possible what Flagler County commissioners have only talked about for several years. The commission approved negotiating a no-bid contract with Charter Communications, itself the beneficiary of over $1 billion in federal subsidies, to extend broadband to underserved areas in West Flagler by the end of 20223 or early 2024.

Weekly case loads fell in 10 of the last 11 weeks and for the past four weeks have been averaging around 50 per week–not as low as the spring of 2020, but still the lowest numbers by far since the arrival of the Delta variant, the supersize equivalent of the coronavirus.

Last weekend’s nor’easter ripped through Flagler County’s dune structures and caused a lot more damage than originally thought, further weakening the dune line that has steadily been losing sand since it was rebuilt in 2018 for $20 million after Hurricanes Matthew and Irma.

A developer is seeking to rezone 40 acres of agricultural land to industrial along State Road 100 near the county airport, land owned by Jay Gardner, the county property appraiser. He says the developer plans a big-box store anchoring a commercial development with restaurants and other out-parcel type businesses. Industrial uses are less clear.

The Flagler County Commission voted to delay for two months a decision on the school board’s request to double its impact fees following a two-and-a-half hour meeting Tuesday evening. The county is not trusting the school board’s numbers, and the school board is frustrated over the county’s resistance to what the district considers an emergency request.

The Flagler County Commission on Monday unceremoniously voted to boot Mike Goodman, the co-owner of Captain’s BBQ at Bings Landing and a voice of prudence on development, off the county’s planning board, just three years after voting him in. Commissioner Dave Sullivan directly cited Captain’s lawsuit against the county and said removing Goodman might spur movement on the lawsuit, which has stalled.
