William Markert didn’t like how fast Cole Nailor was going on his motorcycle.
Nailor, a 21-year-old resident of Lyons Place in Palm Coast, was on his motorcycle, traveling on Ponce DeLeon Drive Thursday morning, when he accelerated past Markert, who was in his own vehicle. Markert, a 69-year-old resident of Pony Express Drive, “raised his hand out of the window, making the gesture for [Nailor] to slow his speed,” according to a Flagler County Sheriff’s report. Nailor stopped–and parked alongside Markert’s pick-up truck.
A cyclist who was nearby picked up the scene that followed in a cell phone video: Markert got out of his vehicle so fast that he forgot to put it in park. “Watch out, watch out, man!” Nailor told him as the truck began rolling. Markert pivoted, got back in the truck as it rolled and managed to stop it.
Nailor had gotten back on his motorcycle. “Come on! Come on, you little punk,” Markert yelled at him. “Take your helmet off.” Nailor got back off his motorcycle and took off his helmet, then approached Markert defiantly: “What?” he told him, head up, chin forward. Markert is considerably taller and wider than Nailor: 6’8” against 5’11”, according to a sheriff’s report. Markert then charges Nailor, pushing him once, twice, three times, and as he did so the third time Nailor attempted to land a strike on Markert’s face, but had to jump to do so. He then backed away, fists raised as Markert kept charging.
At least two passing cars, seeing the fight, blared their horns as the two men ended up wrestling in the swale. It’s not clear from the video, which only briefly shows that part of the fight, who had the upper hand at that point, but Nailor eventually got back on his motorcycle. The sheriff’s report states that the author of the video is unknown. That author sent the clip to Nailor, who turned it over to deputies. Deputies concluded that Markert was “clearly” the primary aggressor.
Nailor was slightly bruised and his left eye was red when a sheriff’s deputy spoke with him. When they spoke to Markert at his home, Markert said Nailor had approached his truck and gotten into an argument with him, and that Markert was punched in the face first. On the way to jail after his arrest on a battery charge he complained of chest pains. Paramedics arrived, evaluated him, and he turned down treatment. He was then booked at the jail on a simple battery charge, a misdemeanor.
“Incidents like this are easily avoidable by not losing your temper,” Sheriff Rick Staly said. “Taking action yourself does not stop drivers from driving badly but often escalates the situation. Road rage often leads to crashes, battery, aggravated assaults, and arrests. I’m glad this situation didn’t
escalate to anything worse. If you see someone doing something illegal on the road or driving in an unsafe matter, don’t take it upon yourself to correct the situation, call us and we will take care of it. Don’t engage in road rage.”

While I don’t condone Market’s behavior I can certainly feel sympathetic.
Numerous times over the past few months I’ve seen bikers traveling at high rates of speed. And committing blatent traffic offenses. And not just the faster bikes. I’ve watched bikes weave in and out of traffic Pass on the white lines and in no passing zones. And they run stop signs by the numbers because it’s to inconvienient to stop. Especially right turns which do matter.
I have lived in Flagler County over 20 plus years. And have only ever seen one bike pulled over. And during Bike Week or Biketober Fest forget it. They get a free pass.
They keep hammering motorists with share the road. And look twice save a life. But it needs to go both ways.

This is and has been an issue on Ponce DeLeon Drive. This motorcycle speeds up and down the road multiple times a day. The road needs a speed bump or the sheriff needs to have a deputy patrol the road a few times a day. Our children can’t even ride their bikes because of the speeding issue on the road.

Looks to me like the younger guy was the aggressor attempting to punch the old guy repeatedly (although unsuccessfully) as the older guy simply used his hands to push him backwards, using his size to his advantage. Strike a blow for the old guy. Too many crazy young punks driving motorcycles at high rates of speed through the P Section. I hear the insane acceleration of those bikes EVERY night coming from that direction. Maybe they need to look at people’s video cams to see if this youngster is the culprit.

Yessir…correct on all of that. This was not a man looking for any trouble. This man takes pride in his surrounding area and blocks around the home that he OWNS, and pays property tax yearly on. Picks up discarded trash, and has always been a great guy. Just a good retired man wanting peace, and was provoked. As you state..we all tire of it and without any periodic traffic enforcement, it gets and has gotten the norm to just let it rip. I have gone myself to the FCSO, maybe we just need more solid complaints to Rick. I never did see the Mustangs or motorcycles I was told would handle it last year. This stuff boils over if untreated, thus why we are chatting now about it. Too many renters, no pride..dumping trash, cigarette butts, fly down the streets, not stopping at stop signs,..then 6 months or a year later..same ol problems in the same rented duplexes and rented homes..just different people in different loud trucks n obnoxious motorcycles..just sayin..

Bad judgement on the truck driver’s part. As a motorcycle rider myself, I wish there was a way to catch these young motorcycle riders that ride what is known as crotch rockets, that they can go as fast as they wish through neighborhoods. There are a few of these idiot motorcyclists that race up my street as well and probably do about 70mph on a daily bases There is one that I can hear racing on US-1 and can follow the direction he/she is going in just by the noise he/she makes. These idiots are risking their lives and everyone else’s by being on the streets. But like the saying goes, “you can’t fix stupid”

attacking someone physically is not the right way to address the situation of course but it is easy to understand the man’s frustration with the cyclist’s manner of driving. this may not have been the first time the bike was speeding by and the more it happens the tension builds. i have listened to neighbors where i live in the F section around the area of Felwood and Felshire about several younger people on smaller bikes almost everyday that speed up and down the streets performing wheelies while standing on the seat. the bikes are obnoxiously loud and it is very annoying. many people have put up “DRIVE LIKE YOUR KIDS LIVE HERE” signs. there is a time and place for that kind of riding and i admire their skills but the riders need to respect their neighbors.

He almost caused an accident leaving his truck in gear (explain that to your insurance). He than places his hands on the other guy first. What we lack here is a failure to have self control. The bikes weaving in and out of traffic is again the new generation of careless non responseable kids who think its “game over” and everybody gets up again. I live on a corner Nd people speed by all hours of the day znd night, a resident two driveways over goes by my house at, at lest 50-60 mph, a school bus goes by every day at 3:00pm at top speed. On a corner! Where is everybody in a hurry to get to? The next red light?

This has been forgotten somewhere along the way. A complete stop is required at red lights and stop signs. I’ve seen way to many near misses from people not complying.

Yes it is legal but you are supposed to slow down and stop before turning. If I am at a red light, I will not make the turn unless I feel safe. I think what he means is that cars will come up behind you and lay on the horn. Ignorance abounds here. I live on a busy street and on a corner and cars, school buses, delivery trucks, city trucks fly by at top speed. We have a couple of motorcyclists that fly by doing at least 70 several times a day and the speed limit is 30! I was going to WM and coming to the turn on Cypress Pt. when a jackass whipped around me, almost ran me off the road, gave me the finger and yelled some vulgarity. Amazingly the brain dead idiot was also going to WM so I just followed him in. I guess getting one car ahead made his day. LOL. Like the gentleman said, where the heck is anyone in PC going in such a hurry?

AFTER a COMPLETE stop. A cessation of movement. I bet 99 out of 100 drivers roll through that right turn on red. Then complain, “I stopped” when the car never actually stopped or even came close. Right turn on red after a complete stop is the law. No one does that.

Ok, let’s get this straight…its simple. PCoast has many renters…the renters do not care about common courtesy or observing speed limits and loud, obnoxious trucks or motorcycles. They move out in 6 months, cycle continues. WE ARE tired of it. We pay property taxes, try to keep a good neighborhood. Yes..these crazy loud, fast motorcycles have haunted this area for years. Each time a deputy comes out, they didn’t see it, so can’t do anything. Went to their FSO ofc in person..Sgt said he would post some traffic cycles n Mustangs around Ponce..never happened. I guess we are stuck with this crap until we can afford a gated community and/ or hoa fees. Get what ya pay for I guess. But yes, when ppl are fed up and so tired of dealing with it, I guess this story happens..sorry it came to this🤨

Yes, a lot of times renters do have something to do with it. Most don’t put stock or time in the area long enough to look at it as their home base or community let alone the structure they rent. Also if the street is a “Drive” most of the people that own their homes and have lived there a while learn to adjust to the area especially while driving. Like slowing down and moving over when their neighbor is walking with or without a stroller, biking or jogging. Most renters aren’t there long enough to share that mutual respect, and once they finally get the hint or you catch up to them, they move and another takes their place. Its a never ending revolving door starting all over again. Speeding, music bumping, cigarette butt litter.

I am a homeowner, own a Harley and a “crotch rocket” and can honestly say I’ve seen just as many cruisers speeding through town as I have sport bikes. This has nothing to do with how they pay rent or pay a mortgage. This could have easily been a middle aged guy on a Harley getting stopped by this older gentleman who thought to take the law into his own hands.
Also, not saying that the kid on the bike was right, but if a truck chased me down and got out of his car, I would also swing first and ask questions later.

You said exactly what I’ve been lamenting on for years.
Rick Staly and FCSO in general are very sympathetic towards the biking community. I have lived in this city for over 20 plus years now. And can’t remember when the last time was I saw a bike pulled over.I watch an equal number of violations from the Harley/Crotch Rocket community on a daily basis.
Several times these have happened with a patrol unit sitting nearby. Case in point during Bike Week this year a pack of at least 15 bikes were coming off of High Bridge onto A1A. The lead bike rolled thru the stop sign turning left and the rest followed. And an FCSO unit had just passed so I know he saw them stopping traffic.
Bikes get a free pass in this area because they bring in revenue. Local agencies have been told to leave them alone for fear of pissing them off. So motorists are now at risk because of their unsafe attitudes.

Have seen and heard about situations going south quickly. How about the truth? Call us and we will probably do very little because we can’t be everywhere all the time. Call us and we will refer you and your issue to another agency. Call us and get repeatedly ignored. A little honesty would go a long way towards initiating an honest and constructive conversation with a community group and in concert with law and traffic agencies, to pursue long term solutions to this, apparently, county-wide problem. Of course that’s assuming willingness to abandon status quo, hand-wringing masquerading around as concern.

You people have NO IDEA how bad motorcycle trouble can get. I lived out west years ago. I remember small towns being takin over by Motorcycle Gangs …… Hells Angels….. Bandidos….. Outlaws (here in Florida)….. Pagans ( up north around Jersey )….. Warlocks….Mongols….Banshees….Iron Order…..etc, etc, etc…………… No police force is big enough in small towns to fight back against these criminals……. I once saw National Guard called out in Arizona to help break up a Motorcycle gathering of 25,000 members of 3 different clubs. News doesn’t cover these types of crime. Be thankful you just have a little “turd” riding around on his crotch rocket……… It could get REAL BAD if the REAL BIKERS come to town !!!!!

Mr. Markert is correct. These kids and no so kids in those bikes are a danger to all and to themselves. The first one to throw a punch was the kid as seeing on the video. They should have gone both handcuffed not only one and to be fair or none. Our sheriff unfortunately after elections is not longer addressing the traffic issues in Palm Coast neither the several times requested litter out of the car windows or the overnight parking in street or right of ways/swales. All speeders; bikers and other vehicles need to be fine as they are not and the parking overnight has also to be enforced as we do not stay up till 1 am to call the sheriff on those violations to be told by the responding deputy that they do not see the vehicles obstructing the traffic…”they are violating the city ordinance Sheriff Staly” and as far as I know Palmcoasters are paying also for enforcing city ordinances like “no truck road and no parking on street or swales overnight and in street during the day. Is getting to the point that we may need to seriously think about Palm Coast own police department. I sure understand this man frustration with that young man. Lets do not forget that a young man biker like that caused the tragedy that killed a teen boy riding on the back of his Suzuki reported at high speed lost control and hit a pole in the Woodlands https://www.news4jax.com/news/local/2020/01/24/teen-dead-after-palm-coast-crash-involving-motorcycle/ and the only solution to prevent that are the installation of life saving soft humps. Speeding motorcycles are an every day occurrence on many residential streets. The City Council has failed to take speeding as a serious problem in Palm Coast. Other cities in Florida use various Traffic Calming Methods to slow speed on residential roads. because they care about the resident’s safety. The Sheriff Office force will constantly have to grow to keep up with the never ending growth. If the City Council continues to vote for growth, then they need to assist the Sheriff’s Office by adopting Traffic Calming Methods for residential neighborhoods and by adding additional personnel to the Sheriff’s Office. Anything short of this speaks of the incompetency of the City Council and lack of caring for residents.

There’s not enough Police Presence. So many people know this. The bad drivers are very confident they will not be seen. So, they continue. Passing very fast over double lines on Colbert Lane and everywhere else. My family and I have noticed a great decline in seeing Police cars. So do those who are just itching to drive recklessly. The population is rising rapidly. The Police Force is not.
