The United States Supreme Court this morning declared gay marriage legal across the United States in a 5-4 decision authored by conservative Justice Anthony Kennedy. The ruling takes effect immediately.
The case, Obergefell v. Hodges, raised two questions, as summarized by Scotus Blog: 1) Does the Fourteenth Amendment require a state to license a marriage between two people of the same sex? 2) Does the Fourteenth Amendment require a state to recognize a marriage between two people of the same sex when their marriage was lawfully licensed and performed out-of-state?
The court answered yes to both questions in a decision that now ranks with Brown v. Board of Education, the 1954 decision that declared school segregation unconstitutional, as one of the last two generations’ most historic advances for civil rights.
“It is now clear that the challenged laws burden the liberty of same-sex couples, and it must be further acknowledged that they abridge central precepts of equality, ” Kennedy wrote. “Especially against a long history of disapproval of their relationships, this denial to same-sex couples of the right to marry works a grave and continuing harm. The imposition of this disability on gays and lesbians serves to disrespect and subordinate them. And the Equal Protection Clause, like the Due Process Clause, prohibits this unjustified infringement of the fundamental right to marry.”
The ruling concludes: “No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice, and family. In forming a marital union, two people become something greater than once they were. As some of the petitioners in these cases demonstrate, marriage embodies a love that may endure even past death. It would misunderstand these men and women to say they disrespect the idea of marriage. Their plea is that they do respect it, respect it so deeply that they seek to find its fulfillment for themselves. Their hope is not to be condemned to live in loneliness, excluded from one of civilization’s oldest institutions. They ask for equal dignity in the eyes of the law. The Constitution grants them that right.”
Kennedy was joined by Justices Ruth Bader Ginsburg, Stephen Breyer, Sonya Sotomayor and Elena Kagan. Chief Justice John Roberts dissented, as did Justices Clarence Thomas, Antonin Scalia and Samuel Alito. Each of the four dissenters filed a dissent.
“I really appreciate that Mr. President,” Obergefell replied. “It’s really been an honor for me to be involved in this fight and to have been able to, you know, fight for my marriage and live up to my commitments to my husband. So I appreciate everything you’ve done for the LGBT community and it’s really an honor to have become part of that fight.”
“Well, I’m really proud of you,” the president said, “and just know that not only have you been a great example for people but you’re also going to bring about a lasting change in this country. It’s pretty rare when that happen, so I couldn’t be prouder of you and your husband. God bless you.”
Moments later Obama spoke to the nation. “Today we can say in no uncertain terms that we’ve made our union a little more perfect,” he said. Toward the end of a speech marked by his deliberately halting delivery of phrases harnessed to a momentously historic moment, he appeared less guarded and more emotional. “That’s the consequence of the decision from the Supreme Court. But more importantly, it is a consequence of the countless small acts of courage of millions of people across decades who stood up, who came out, and talked to parents, parents who loved their children no matter what. Folks who were willing to endure bullying and taunts. What a vindication of the belief that ordinary people can do extraordinary things. What a reminder of what Bobby Kennedy once said about how small actions can be like pebbles being thrown into a still lake, ripples of hope cascade outwards and change the world. Those countless, often anonymous heroes, they deserve our thanks. They should be very proud. America should be very proud.”
Roberts, who read his dissent from the bench–the first time he has ever done so–ended his 31-page opinion with bitter words: “If you are among the many Americans–of whatever sexual orientation–who favor expanding same-sex marriage, by all means celebrate today’s decision. Celebrate the achievement of a desired goal. Celebrate the opportunity for a new expression of commitment to a partner. Celebrate the availability of new benefits. But do not Celebrate the Constitution. It had nothing to do with it.”

Roberts was begrudging process more than whether gay marriage is just or not. At the top of his decision, he wrote: “The people of a State are free to expand marriage to include same-sex couples, or to retain the historic definition. Today, however, the Court takes the extraordinary step of ordering every State to license and recognize same-sex marriage. Many people will rejoice at this decision, and I begrudge none their celebration. But for those who believe in a government of laws, not of men, the majority’s approach is deeply disheartening. Supporters of same-sex marriage have achieved considerable success persuading their fellow citizens—through the democratic process—to adopt their view. That ends today. Five lawyers have closed the debate and enacted their own vision of marriage as a matter of constitutional law. Stealing this issue from the people will for many cast a cloud over same-sex marriage, making a dramatic social change that much more difficult to accept.”
Acceptance, however, is broad across the United States. While just 10 years ago overwhelming majorities of Americans opposed same-sex unions and showed their disapproval at the polls through numerous amendments to their state constitutions, including in Florida in 2008, a shift began, in 2004, when Massachusetts became the first state to legalize same-sex marriage–through a court decision, not a legislative one. That decision began an extraordinarily rapid shift in the country that has since led two-thirds of states to legalize gay marriage, either through court decisions or the legislative process, while popular approval for gay marriage has shifted to majority approval. The shift, its depth and manner, belie the chief justice’s assertion that courts should not have played a role.
Scalia, like his fellow-dissenters a Catholic who’s long opposed gay marriage in principle, leveled a broadside at Kennedy in a footnote: “If, even as the price to be paid for a fifth vote, I ever joined an opinion for the Court that began: ‘The Constitution promises liberty to all within its reach, a liberty that includes certain specific rights that allow persons, within a lawful realm, to define and express their identity,’ I would hide my head in a bag. The Supreme Court of the United States has descended from the disciplined legal reasoning of John Marshall and Joseph Story to the mystical aphorisms of the fortune cookie.”
Reactions poured in quickly.
“We’re getting lots of comments from all over the country where courts and clerk’s offices are now performing same sex marriage,” one of the authors of Scotus Blog, first to report the ruling, reported at 10:51 a.m.
“This is an historic win for couples in Florida and across the country,” ACLU of Florida Executive Director Howard Simon said in a statement. “Six months ago, the freedom for all to marry was secured in Florida when a federal judge issued a ruling in our case that struck down Florida’s ban on marriages for couples of the same sex. Today’s historic ruling means that victory – and similar court victories across the country — will stand and that the remaining states will all be barred from refusing to issue marriage license to loving and committed same-sex couples. The Supreme Court has affirmed what a majority of Floridians and indeed all Americans have come to understand: that the freedom to marry is a precious and fundamental right that we all share under the Constitution, and that no family should be denied that. We are proud of our colleagues from the two ACLU lawsuits that were among the cases that brought about this decision. But more importantly, we are thrilled for the hundreds of thousands of couples and their families for whom this victory has been decades in the making.”

Without expressing an opinion either way to todays ruling, or yesterdays, I can’t help but notice the irony included in the Chief Justice’s dissent today, given what he did yesterday while writing for the majority. “But this Court is not a legislature. Whether same-sex marriage is a good idea should be of no concern to us. Under the Constitution, judges have power to say what the law is, not what it should be. ” Yet, yesterday specifically because he and colleagues knew Congress could not fix the language in Obama Care, (because they don’t have the votes to) he decided to give new meaning to words and thus decided what the law should have been, rather than what it was.

Those of you that are disgusted by yesterday’s obamacare ruling and today’s upholding of the legality of same-sex marriage, there is hope: Uganda made homosexuality a crime that draws a sentence of 14 years to life and has almost no viable healthcare for the poor. It truly is a nation that’s embraced the power of the free market, so my advice is to look in to emigrating there. The only downfall I can imagine for you is that it’s populated by black people, which might go against your closely-held conservative values.

Apparently Justice Scalia thinks that gay marriage is a threat to American democracy, and Thomas, well, considering the company he likes to keep his opinion only counts as 3/5 that of any other justice.

Did you read or hear any of the descending opinions? Justice Roberts questioned the legality of this ruling. At lease one of the female justices (maybe two of them) had performed gay weddings and she or they should have reclused herself/themselves. The court has clearly invented law out of thin air.
What will happen next? Will priest and other clergy be sent to jail for refusing to marry gays? Already, bakers have been put out of business for refusing to make a wedding cake for a gay marriage. The gays deliberately seek out businesses who they know are religious to put them out of business. What about their civil rights? The gays are not satisfied with just winning, they want to ram this down the throats (no pun intended) of people with strong religious convictions. This is an attack on religion.
This issue won’t go away just like Roe v. Wade has not gone away.

Sorry to get in the way of your political fear-mongering but no, clergy will not be jailed for refusing to perform same sex marriages. It’s settled law that the government cannot force clergy to marry anyone, or allow them to use their church, and they exercise that right everyday.
It’s disingenuous of anyone on the right to complain about economic boycotts for social purposes, since it was the right’s Moral Majority that invented them back in the 1980’s. I know many good very religious people who support same sex marriage. This isn’t an attack on religion. This is an attack on bigots hiding behind their religion for cover.

NO one is going to be sent to jail for not doing a wedding. Religion freedom is still allowed in the United States. What you can’t do is impose your beliefs on someone else because your God said so.
Also any smart businessperson would have refused in a civil way to make a cake for a gay couple. I turn down jobs all the time because the client is giving me a bad vibe or the job is just too difficult to make money for the effort. That bakery failed because if failed to realize the customer is always right. All they had to do is call another bakery and say they had a request they couldn’t fulfill and the cake would have been made.
I wasn’t able to get married where I wanted because I wasn’t a member of that church. I had the check ready and the date picked out but they refused. I moved on to another place and they did much more for less money.
Question though.

That’s the point, this is an attack on religions. Gays are deliberately seeking out businesses to destroy them because of their religious beliefs. It’s not enough for them to be able to marry, they want to destroy religion. They have already started by attacking a baker who refused to bake a wedding cake for their wedding even thought there are dozens of other bakers who would be happy to bake them a wedding cake. The baker stated he had no problem selling them donuts, cookies, bread, whatever he had for sale in his bakery, he just didn’t want to bake them a wedding cake. Same thing has happened with photographers, florists, wedding planners, etc. The gays are on the hunt to seek those with strong religious view out and destroy their businesses and lives. Where is the justice in that? After they have succeeded in destroying these people, I predict they will eventually move on to churches. First they will attack social services and charities run by the churches, eventually they will demand that priests, ministers and rabies marry them. It’s just a matter of time.

The devout baker should become a baker for the Diocese and make all the holy cakes they want but when they are licensed to do business publicly and tax dollars support the health inspections of their business they are now operating in the secular world and cannot discriminate. The wedding cake example may seem trite but extend your argument further and consider all the other businesses that could start to discriminate based on religious grounds, the venue for the reception, the travel agent for the honeymoon or even the landlord for the newly weds first apartment. Why should they not be treated equally, because the business person object to their lifestyle? Like I said, OK for the Taliban and the Ayatollahs but not in this great nation.

Two justices, Kagan and Ginsburg have performed several gay weddings. They should have recused themselves from hearing this case. They were obviously prejudiced and had already formed an opinion on the issue before the case came to the court. There is no punishment by not doing so other than impeachment, but they are unethical and dishonest. Every branch of government is legally capable and Constitutionally able to make legal provisions (another way of saying making law). The extent of which they do so is also written by a long tale of precedent and necessity. There is a difference between legislation (general law), administrative law (Executive Branch), and Court Mandate / Ruling (Judicial Branch). It is both disingenuous and a mischaracterization of these branches of government to assert or assume they do not “make” law. It would be accurate however, if you said the Judiciary is not the branch of origination when it comes to law… Only interpretation and ruling.
As for Justices not voting due to personal interests… The same can be said for all of the Justices who seem to vote according to party line a majority of the time. The problem with our system is not our system.. It’s the education of our system. Social and Civic Studies have been replaced by a dumbed down version of American Government. There used to be a time when most people just listened to smarter people and experts because they trusted in greater education… Today, everyone seems to be an expert on every topic.

You can freely carry a weapon with a Florida permit but that permit may or may not mean anything in another state like NY, Washington State or NJ and you can go to jail for carrying a weapon even if it is in your trunk or glove box.

My references are based upon historical fact that can be verified in official government records. It would take a very long time to dig them out of the Congressional record, Library of Congress, but they are there. Also read what newspapers printed while this was actually happening.
In a nut shell, the Congress passed the 13th amendment with the help of the Southern states after the war and when they were seated in Congress to vote. Then it came time for the 14th amendment, Congress saw they didn’t have the votes for it to pass, so the passed the reconstruction acts and kicked out the entire Southern delegations. These were the same Congressmen and Senators who had voted to approve the 13th amendment. You can’t have it both ways, either the Southern delegations were not qualified to vote for the 13th which would make it null and void or they were qualified to vote for the 14th which would make it null and void.
What do you think would happen today if the majority GOP houses of Congress voted to unseat all democrats and then proceed to impeach Obama which they have the power to do. What a novel idea, I think I’ll write my Congressman and Senators and suggest that. While their at it, they can also vote to unseat Kagan and Ginsburg.

To those who maintain that their “religious freedom” supersedes the U.S legal system, in addition to your Christian bible, does religious freedom encompass teachings of the Quoran, the Torah, the Vedas, and tenets of other legally valid religions such as Wicca? I’m interested in the answer, because if you contend that your Bible alone superceeds our secular legal system, then we’re going to need a mechanism to arbitrate differences between Christian tenets, as you and millions of others interpret them, and our secular legal system. Quite obviously you don’t trust the biased, secular Supreme Court. So America probably needs a Christian Ayatollah to make final decisions, and thus we evolve into an Iranian-like theocracy. Goodbye democratic secular America as envisioned by the Founding Fathers!
And if you generously allow ALL religions in America to independently supercede our legal system, then you get legal and civil chaos with practitioners of each religion determining which laws they will accept and obey. Given the theological differences within and between religions, and add in the voices of humanists and athiests, there would be no hope of agreement on virtually any issue. Then you get an Iraqi-like divided and very contentious confederation of red, blue and purple “states”, each with their own set of rules.

The state should only issue legal contracts, not marriage licenses. The institution of marriage is a church issue and under the separation of church and state theory, the state is infringing on the church’s jurisdiction. Marriage licenses were never issued by governments until about 150 years ago, It used to be the sole responsibility of the church of your choice.
