Flagler 911: The Live Crime Blotter: April 27-May 8, 2011

The following incident and arrest information was compiled using official documents, reports and affidavits obtained from government and law enforcement agencies. This feature is not inclusive. It is a sampling of reported incidents in the Flagler County area. Note: The U.S. legal system provides the presumption of innocence to those charged with a crime until guilt is proven in a court of law.

Stolen Toyota on Atlantic Drive (Warning: The Word “Stolen” Is Used Loosely)

A deputy reports that the morning of May 8 he responded to 43 Atlantic Drive in Palm Coast in reference to a stolen vehicle. The deputy reports: “Upon arrival I made contact with Evelyn Wagner (the victim) and James Langton (the complainant). Evelyn stated that she awoke this morning to find her 2004 Toyota Highlander (FL tag LR613) missing from her driveway. James, who rents a room from Evelyn stated that he used the vehicle last night with Evelyn’s permission and was home by 9:30 PM. James stated that the vehicle was unlocked with the keys in it as that is what Evelyn does. Evelyn stated that the vehicle is paid for and the only other person who has permission to use it is a male named Mike Marinelli who did not use it. Evelyn stated that Mike lives on Shady Lane and does yard work for her and that is all the information she had on him. James stated that another male (Hal Grimm) lives with Evelyn also. James stated that Hal would not have taken the vehicle because he was home all night and does not have a drivers license. The Hal subject was not at the residence at the time so I was unable to obtain any further information on him. Evelyn did state that she received a call from an unknown person yesterday afternoon inquiring about the vehicles mileage. Evelyn did not write the number down or know who it was. I also contacted the neighbor directly across the street at #44 who stated that they did not see or hear anything.”

Underage Drinking Party on Royal Palm Lane

The morning of May 1, at 1:38 a.m., a deputy responded to 13 Royal Palm Lane in Palm Coast in reference to a noise complaint regarding a loud party. The deputy reports: “Upon arrival I observed two people sitting in the back of a red SUV with cars lining both sides of the street near the residence. I made contact with the two people inside the SUV who identified themselves as being 15 and 16 years old. Between these individuals there was an open container of alcohol (Natural Light beer can) which was still cold to the touch. As I walked around to the rear of the residence approximately twenty individuals who all appeared to be under the age of 21 were standing on the back porch and several of them had open alcohol containers in their possession. Eric Carias identified himself as having control of the residence and stated he currently lived there. Inside the residence approximately forty other individuals were located with none of them advising they were over the age of 21. There were open alcohol containers spread throughout the inside and the outside of the residence. I also smelled the odor of burnt cannabis throughout the residence which I identified through my training and experience. Of the individuals who stuck around (approximately twenty) several of them admitted to consuming alcoholic beverages and approximately half of them were under the age of 18. Everyone under the age of 18’s parents were notified of the situation and they were released either to their parents on scene or a sober adult on scene with their parent’s permission. Eric was placed under arrest reference an open house party and given a Notice to Appear.”

Really? Leaving Your Oxycodone Prescription in Your Car, Unlocked, With the Windows Down?

A 33-year-old resident of Palm Coast reported that the afternoon of May 2 she was running errands when she stopped at the Ocean Shore Publix in Flagler Beach between 3:30 p.m. and 4 p.m. She left her just-filled prescription for Oxycodone in her car. She left her car unlocked. And the windows down. And went into a store. When she came out, the prescription was gone. The victim told a deputy the following day that she needed a police report that day in order to get a refill. The deputy told her that it would be at least three days before a report would be available.

Vandalism at Linear Park

On May 7 a deputy reported that the toilet paper dispenser and urinal divider at Linear Park’s public bathroom had been ripped off the wall and left on the ground. There was minor damage to the wall. Symbols were written ion marker on the bathroom mirror. The nature of the symbols was not reported in the police report. The park is run by Palm Coast.

Texas Instrument Chain Robberies at Target

The evening of May 6, just before 8 p.m., a deputy responded to a shoplifting call at Target on State Road 100 in Palm Coast. He spoke with Michael Ledrich, a Target employee assigned to monitor shoplifters. An hour earlier, one of the fire doors to the building was opened setting off the alarm. There was no fire. The employee was concerned that someone may have used that door to exit the building with unpaid for merchandise so he called other local stores to advise them of what happened. He told the deputy that numerous stores are usually hit consecutively. Ledrich said that when he spoke with the St. Augustine store, they advised him to check the electronics section of his store because they had a larceny a few months ago where a suspect stole graphing calculators and left through a fire door. Ledrich then went to his electronics section and discovered that numerous graphing calculators had been stolen. He then checked the security video and located a suspect–a black male wearing a white T-shirt and a white baseball style hat, inn a gold colored 4-door sedan. Ledrich said the vehicle circled the parking lot several times before the male came into the store, put a large place tote style bin in the cart and went to the aisle with the calculators. The male then ripped the metal holders off the display and put the calculators in the tote covering them with the lid. Ledrich told the deputy that the male then hid the cart in a clothing section of the store and exited out the front doors. The male then went out to the vehicle, got into the passenger side, and was dropped off at the front door as the vehicle went to the west side of the store and parked near a fire exit door. The male then entered the store, took the tote bin out of the cart, walked through an unsecured “employee only” door and exited through the fire exit door. The male got into the vehicle and the vehicle left the scene in an unknown direction. The property stolen included several Texas Instrument calculators worth $95 to $125 each. The Orange City Target had a similar case of shoplifting in January, according to Ledrich, so did the St. Augustine Target in March.

Domestic Battery in the Shadow of an AK-47

Willie Gilyard, 32, was jailed on charges of domestic violence, felony child neglect and and failure to safely store a firearm on May 2 after the 11-year-old son of Gilyard’s girlfriend, on his mother’s request, called 911 to say that, according to a police report, “his dad was hitting his mom.” Investigating the incident at Seabury Place in Palm Coast, the deputy observed two scratches on the face of the 30-year-old victim, both bleeding–one on her forehead above her left eye, and the other beside her right eye. She also had red marks around her neck and a scratch on the left side of her neck. When asked what happened, she began crying and was very hesitant to describe what took place, saying only that she’d been arguing. She then explained that when Gilyard came home, he accused her of cheating, which she denied, and demanded to see her Facebook account. The deputy’s report continues: “While further investigation was being conducted I spoke to (child’s name omitted) who stated that this was not the first time he has seen Willie hit [his mother], but this is the first time that [she] ever told him to call the police.” Deputies also discovered an AK-47 rifle inside the residence, leaning next to the front door, with a shirt hanging on it. When the rifle was checked for its safety, it was determined that there were no safeties nor trigger locks on it. The rifle had a round loaded in the chamber and seven additional rounds in the clip. This was a very high concern due to the couple having four other children inside the residence, all under the age of eleven years old. A record check was conducted through teletype which came back negative, but the rifle was seized and placed into evidence. Willie was transported without further incident to the Flagler County jail. The Department of Children and Families was contacted.

Memo to Student-Vandals at Buddy Taylor Middle School: It Isn’t Smart to Leave a Calling Card

On May 2, Paul Peacock, assistant principal at Buddy Taylor Middle School, contacted the deputy assigned to that school to tell him that the gymnasium’s bleachers had been sprayed with graffiti. “The odd thing about the graffiti,” the deputy reported, “was that it was two students’ names, date and time they were there.” The students could have written other people’s names. But the students apparently didn’t know the place was under video surveillance. The video confirmed that the students had written their own names. Also, that they entered the building from an unlocked door after midnight on May 1, played around with a few items left on the gym floor, left their graffiti calling card, and left through the same door. The school requested that a civil citation be issued instead of criminal charges. The students will be expected to carry out some community service and attend certain classes.

Stealing from a Mayor in Beverly Beach

Steve Emmett, Beverly Beach’s mayor, reported to a deputy on May 2 that a friend had returned a Milwaukee Sawzall–an electric saw–to him on April 27. The friend had put the saw on the walk between the garage and the residence, at 133 Anchorage Drive in Flagler Beach. Emmett told the deputy that he forgot to bring the saw into the house, and that by April 29, he noticed it missing. Neighbors told the mayor they’d noticed nothing unusual, and Emmett didn’t have the serial number of the missing saw.

Other Burglaries and Larcenies And Petty Crimes

Burglary reported on May 8 at 80 Kalamazoo Trail in Palm Coast, where solar-powered yard lights and wheels and tires were stolen.
Amanda Bryant, 21, was jailed on a burglary charge after the resident at 23 White Dove Lane accused her of breaking a door frame in an attempt to get into the house, against the resident’s wishes, and causing $100 in damages.
A watch was reportedly stolen from a house at 103 Boulder Rock Drive in Palm Coast on May 6. The watch is a G-Shock Casio.
Boat trailer reported stolen from Flagler Pines Storage at 5845 East State Road 100. The theft would have occurred sometime between December and May 3.
Black, 6 foot by 10 foot trailer reported on May 4 at 35 Enterprise Drive–Matt’s Incense–in Palm Coast.
Rims and tires and gasoline reported stolen at 2829 Sandlewood Lane in Bunnell on May 1.
Shoplifting of ladies’ shirts and denim ladies shorts reported at Bealls on May 4. The shoplifting involved people of the following ages: 25, 44, 42, 16 and 14.
