Palm Coast Threatens Waste Pro with Litigation and Fines It $125 For Every Recycling Bins It’s Taking Back
At worst, it looks like retaliation. At best, it’s puzzling for a company that claims to “never throw away an opportunity to show our gratitude.”
Waste Pro, in its final week as Palm Coast’s garbage hauler, is driving through neighborhoods with a flatbed truck and taking back the recycling bins it freely provided residents over the years. The seizures are in apparent violation of city code. The city considers them a violation of the company’s contract.
The city is fining Waste Pro $125 for every bin the company is taking, citing city code, which prohibits the removal of bins without the city’s authorization. The city is also considering litigation against Waste Pro. Neysa Brkert, the city attorney, said she could not go into details about the case because of “this potentially pending action that may result.”
“The understanding was always that the bins belong to the residents, but waste Pro today started picking up all of the bins, claiming they own the bins,” Brittany Kershaw, the city’s communications director, said. “We’ve had some legal dialogue going on over the pasts several days between our attorney and their attorney about the ownership of the bins. We did not know hat they had planned to collect the bins today.”
Nothing in the contract states that the bins would be repossessed. Residents never signed documents intimating that they would have to give back the bins. In the 16 years Waste Pro has been the local hauler, thousands of residents have moved out of town, taking the bins with them. Thousands have moved in with bins of their own. It’s not clear how Waste Pro is distinguishing between one and the other as it picks them up.
Over the years, the city has told residents that they could keep their bins. “Now we’re at the point where we have to collaborate on a new plan to give residents new bins,” Kershaw said.
It was always FCC Environmental plan to provide bins to some residents, like new tenants or to those who need replacements. But there was no plan for a wholesale replacement, which would be expensive and time consuming.
Waste Pro did not respond to questions emailed its communications manager before this article initially published. In a full-page ad in the Observer today, the company said the city “chose a new provider for its residents. At Waste Pro, we never throw away an opportunity to show our gratitude.” It then said, without additional explanation: “Please be patient as the city works through replacing your recycling bins.”
The message does not explain why the company is hauling off the bins, or what residents are expected to do with their recycling meanwhile. Most residents use the bins during the week to store their recyclables.
“There was nothing in the contract that said these bins are going to be collected upon termination and taken back from city residents,” Borkert said.
The contract with Waste Pro does not spell out explicitly whether residents own the bins. But the bins were purchased on behalf of residents and given out to them free: two bins per household, with a third bin or more provided at a cost. Since some residents paid for their bins, it creates yet more dubious instances where purchased bins–which would unquestionably be the residents’ own–would have been hauled away, since purchased bins were not distinguished from those freely provided.
“We have been fining Waste Pro all day today for each bin that they collect because it is stated in their contract that they will return the bins to the areas where they picked up for collection,” Kershaw said. Code enforcement is keeping track of the civil fines.
The city issued a more neutral-sounding press release earlier this afternoon, informing residents that bins are being collected by Waste Pro, with new bins to be delivered, imprinted with the city’s logo.
Residents in need of a replacement recycling bin, the release states, are encouraged to submit a case by visiting palmcoast.gov/connect. Once on the site, select “Create a Case” > “Trash” > “Recycling” > “Concern/Question.” Residents may also call Customer Service at 386-986-2360 or email customer-service@palmcoastgov.com.
During the implementation process, residents who may be awaiting a new recycling bin can utilize a container from home to hold recyclables. An example of a temporary recycling bin may be a plastic tub, a cardboard box, or a laundry basket. Please clearly mark the personal bins with the words “Recycle” in order to avoid confusion with regular garbage waste. Proper labeling will help the residential collections team effectively identify and collect recyclable materials.
Each residence is allowed 35 gallons of recycled materials each week, and the bins being delivered will hold 18 gallons of recyclables, which is the standard size.
The release also suggests that if residents are interested in a larger bins, recycling containers are available for purchase at local hardware stores and supercenters.
During the 2016 bidding process, a question was asked through the city website’s procurement portal about recycling bins, and the answer, by an unnamed staffer, suggested that the bins belonged to the provider. The company is relying on that documentation to make its stand.

I don’t see a problem with them taking back what they gave (for free to use) to the residence of PC. If they are not the contracted company to pick up the trash or recyclables, then they get their bins back. Let the new company supply the residence of PC with new bins. This is just another sign of how our city council doesn’t think through everything when they negotiated for the new carrier. So the troubles begin right from the start, now the new company will have to supply new bins or the city will, or not pick up recyclables. But for some reason I’m thinking the city council will add some extra charge to the utility bill for new bins. I’m thinking everyone in PC should invest in vasaline and learn to bend over to touch your toes.

I lived thru a similar transition in Nassau County FL (Yulee). There were 2 companies that competed. One went out of business & sold off it’s assets to the other. That was a case where the trash receptacles were provided by the respective competing companies. So there was nothing adversarial about the trash receptacles for each residence the trash receptacles were rather viewed as part of the monthly fee and that each was assigned to the property.
What did the City of Palm Coast think WastePro would do, abandon their waste receptacles when the drop dead date happened. The company (European, based in Spain as I recall) needed to have a receptacle distribution program plan in place for the day WastePro would end service in the city limits of Palm Coast. What WastePro is doing isn’t retaliatory, is it even a fine-able issue ? They are transitioning for the day when service to Palm Coast was supposed to end.
Think about the names that keep being elected in City of Palm Coast Government, because it’s the same one’s that have bought moldy buildings, same one’s that approved Tennis Center expansion for Pickleball courts, same one’s that brought us into litigation era over a Splash pad that maybe was operational 2 weeks without needing maintenance & eventually didn’t work thru the 1st summer before a complete shutdown. Ever notice everything Holland, Alfin, Klufas has resulted in litigation ? That’s not competence and these are 2 of 3 leaders that are supposedly getting more seasoned & experienced as time goes by, the other resigned & is no longer a threat to the residents/voters of the city of Palm Coast. The progress of the county or city in this case were hailed as great accomplishments. In the next 5 years we’ll all be paying more for swale and storm water fees in bills & taxes. We’re also going to see increases for waste collection. It’s the Biden Inflation era of America. Instead of paving roads they grew the city/county to the point the roads wear out sooner with increased traffic. Government pissed away any funds that would pave roads.

Honestly, Waste Pro has been nothing but on time & reliable service in this residential. The complainers, those are the folks that don’t properly bag their garbage for pickup. they are most likely renters that are constantly putting trash & furniture curbside. I end up picking my neighbors trash from my yard because the garbage they put out is wind blown airborne debris. Often it’s receipts with their names indicated from a fast food restaurant or even a local retailer. Secure your garbage better & it won’t be on the streets or in other’s yard(s).

I agree with so many of the above comments. Waste Mgmnt. is not doing anything wrong. They provided a service with containers, now their service is over, they have every right to pick up their containers. I would almost bet that say the city had provided a service with containers and their service time came to an end, the city would be doing the same thing. I definitely agree with the above comment about the Vaseline. This is what it’s coming to folks. How much more are they going to tax us for now defunct parks(2 within the same park come to mind) housing prices, water and sewer and now the code enforcement will be following around the trash trucks (great use of time and money by the way) but hey maybe code enforcement will stop harassing residents about stupid things like grass being an inch too tall or someone having a yard sale or even a business vehicle parked in a driveway.
I moved here because I thought it would be a good place to raise a family, can’t even afford to that anymore.
What a very sad town we live in when this kind of stupidity about trash bins comes up. There are bigger things that should be dealt with first.

I never had to pay for any recycling baskets here since 1991 and I am not going to start doing it now FCC has to provide them for free and I do not expect that their cheer leader in the city forces Waste Pro to give them for free to FCC their buddy. They forced a change in our services and starts in the wrong foot already. I have always gotten my recycling baskets for free and they are not going to force me to pay for them to their choice FCC that was not ours. I will put my baskets out this coming Thursday for Waste Pro to collect. A will expect my new one’s from FCC delivered. Stop the malfeasant with our services also over some recycling baskets. Enough our hearts are broken to see our excellent Waste Pro workers going for not valid reasons. We need new elected officials and new administrators in 2024 this city and when we ask for FOIA documents request form some administrators contacts with developers or contractors they should not be demanded to be paid $29 plus an our to copy emails or text, call records requested as per Florida statute: Section 119.011(12), Florida Statutes, defines public record as:
“all documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law or ordinance or in connection with the transaction of official business by any agency.”

Same reason why city is not provided FOIA requested records and asking to be paid almost $30 and hour for a total over $117 to a resident? I am going to return their rightfully owned recycable bins to Waste Pro even if I have to drive them myself to them to Bunnell of where ever! So better your protegee deliver for free their bins …going to improve the look of our city pother than all the same looking bens on Thursdays a bunch of ugly containers provided by residents instead…Now the city wants its logo @$125 on the bins and they want us or Waste Pro to pay for it? Hell NO! They waste money by keep on changing new designed logos and stationary over it that is very costly and unnecessary just to grease someone’s pockets. Does this “City Council” do anything right? Who coordinated the changing of Waste Pro to FCC? Where was the “City Council” checking to make sure that this would be seamless for the residents? They even had a chance to get rid of these antiquated bins and go to wheeled 96 gallon containers like many other towns. Before we moved here our service was changed twice in 6 years up North from Groot to Waste Management to MDC, no problems you only noticed you had a new wheeled container each time, picked up once a week not this wasteful twice a week. As one company was finished and picking up their bins the new company was delivering new bins to the neighborhood an hour or so later, too easy. Not holding my breath that trash pick-up is going to get better, if I remember wasn’t it FCC that wasn’t picking up in the Orlando area for weeks at a time? Will shall see.

Need I also say that the garbage collectors (purposely?) leave trash containers in the middle of the driveway, thus blocking the entry path and making it impossible to pull into the driveway without running over the container. I have to get out of my vehicle and move the container aside just so I could pull into my driveway. This has been going on for 2 months now.

You might be correct that the city didn’t pay for them. But you and I know the city council doesn’t give the residence anything for free. I’ll bet someplace in the billing cycle of the residential monthly bills the cost of the bins were hidden in there somewhere. It might come out in litigation that is the case. But they were not free.
However, my bin just has the recycle logo on it with no name and they returned it to my property after they emptied it today. My two neighbors next door had their bins taken because they had the name waste pro written on them.
I think that the 125.00 fee per bin is ridicules because the bins probably only cost about 20.00 each being they were purchased in a extra large bulk. Just the city price gouging waste pro. But on the other hand the city might have charge each residence the 125 per bin in the hidden charge on out utility bills. Bottom line is that it is all BS from the city. But it was like a parade of vehicles that came by this morning, the recycle truck, a pick up truck pulling a 16′ duel axle open trailer carrying with two guys in it taking the bins, and two PC city pick up trucks and then a red pick up truck but I can not make out the name on the side door on my surveillance video, so I don’t know if it belonged to the parade or not. LOL

Out here in Unincorporated Flagler, we will continue to have Waste Pro for services per the county decision.
My recycle bins are WP bins & are always thrown down on my concrete driveway & are chipped & cracked to the point of needing replaced. So exchange them with some of the ones that are being collected in Palm Coast if they are in better condition.
My yard waste cans are my property & they treat them the same way.
No respect for personal or company property.

I so wish that Waste Pro would come pick up our bins and go away for good! Hell, I’d pay them! I am now convinced that WP treats different neighborhoods differently, because they have so f’d up our Hammock so many times. I wanted them to prorate the many times they passed us by and left our bins and garbage cans, up and down our streets, full for, maybe, the next pick up.
Lake Worth lent us two bins as requested. One large roll away for recycle and one small roll away for garbage. Their truck was automated, and scooped up the bins and emptied them. Once a week, they came and clammed up our plant debris. I guess we were really spoiled!
I still maintain that Flagler Beach has a great bunch of guys, who are friendly and efficient. They are trying their best to REALLY recycle. We’ve seen WP throw recyclables in the trash truck, and we would really like someone to honestly report whether they really recycle or not. We have our doubts.
We were very disappointed that the county signed up with WP again. What a let down!

I just moved in in March and the lady at the Recycling place in Bunnell who I got my bin from wouldn’t give me more than one because she said I’d be keeping the one she gave me and can ask the new company for another one when they take over. That was only 2 months ago. Not to mention how I was taking my bin in today, I was in my garage, and the man on the truck literally yelled at me and demanded the bin back out of my hands (in the rain!). Rude!!

The bins were set out on city property to be emptied as per normal. Waste Pro emptied the bins and then loaded their bins onto their truck for return to their facility. No WP workers trespassed private property. If you think your property extends to the edge of the roadway, you are mistaken. Take a good look at your survey.

Not what I’m saying at all. But I’ll bet they were not free. Somewhere in our monthly utility bill there is the hidden fee for the bins. Maybe in the increase from 2018 to 2022. But maybe during litigation it will come out. I must be the lucky one because my bin was not taken today after being emptied. But then again, mine only had the recycle log on it. However my two neighbors bins right next door had waste pro written on theirs and their bins were taken. I watched this on surveillance video and saw the parade of vehicle that followed the recycle truck.

The property that they are going on belongs to the city, it’s the easement where most everyone puts the trash and recycle bin for pick up. Yes you have to maintain the property your house is on up to the street, but the first 15′ belongs technically to the city and they can do what they want there. Pretty much it’s the swale area. So technically the trash employees are going on city property, if they even touch foot on the grass at all.

Residents shouldn’t be taking the bins for themselves if they move. You call your new waste collection provider, in your new town or city, and get new bins from them.
And I’m sure Waste Pro has their logo on the bins that belong to them. I have doubts that they’d circulate blank recycling bins.
Just give them back. You told them to screw off, you shouldn’t be allowed to keep what’s clearly their property, it literally has their name on it.

Brian: WP has, on many, many occasions bypassed our streets completely. Left our full bin, or cans right where we put them. The only real reason, I believe, that they would bypass whole neighborhoods, not once, not twice, but again many times is because they were told to. I’m not going to pin that on the collectors. Others here have stated that they have NEVER had a problem. That is clearly not our experience.
When we put our recycles out, a couple days before our pickup date because of a pending hurricane, we called WP and told them our street was skipped. WP told us to take our stuff back in! Take it all back in where? Inside our houses, bugs, dirt, leaves and all? Because they intentionally skipped our neighborhood?
Many times they have left our plant debris behind, even though we had it all properly canned, and/or piled within their requirements. Then, the next time for pickup, they red tagged us for having too much! Of flipping course, we had to add to the pile! We got that one reversed. However, we are charged for pickup on pickup days, and not prorated on missed days.
Oh, I don’t have the patience to continue with how many times we called WP or texted/called/emailed the county over WP. It can’t be because of one crew v. another.
According to us, WP sucks and we wish they were picking up our bins and high tailing it for good. That would be great!

In fairness (and I have had great experience with Waste Pro teams) since the bins were clearly marked all over “Waste Pro” I always assumed they owned them and provided them for our convenience while they were our provider.
As such I would have hoped PC Council would have a plan to get the new provider they shoved down our throats to provide us something while they are the contracted provider. But PC Council never really have a plan that helps residents, what was I thinking?

“Without notifying the City with ample lead time”. What the devil are you talking about? The city fired Waste Pro, told them to get out of town by a certain date. They did and took their equipment with them. Did you pay for that bin? I did not. What are you going to suggest next, that Waste Pro leave their trucks for the new company? Makes just as much sense as them leaving their recycling bins. The city screwed the pooch.

Mark isn’t it funny the trucks wipe through neighborhoods on the second pickup because most people do not need it, however, crews are not going to tell HQs because they will cut a days work and the crews don’t want that!
nd my elderly neighbor puts stuff out every time because he’s paying for servicee so therefore he uses it even if its a short week for him/wife and they only have a small tied-up bag it gets wheeled to the street regardless, the pickup guy usually shakes his head and leaves

“Without notifying the City with ample lead time”. What do you mean “no ample lead time”? The city fired Waste Pro, FCC and Waste Pro were given the termination/start date. I have both recycle bins, one with Waste Pro on it and the other has just the recycle logo. We’ll see what’s left. The bins came from WP and should go back to WP. As far as the garbage cans go, each resident purchased for themselves. Mine came from Ace Hardware in Bunnell. In all my years here, never did I hear or see anything about the city providing cans except for when there was talk of using automated garbage trucks and required special cans, but that didn’t happen.

The WP bins clearly have WastePro printed on them. Given this fact, a reasonable person could say the bins belong to WP. If the City plans to use OUR money to sue they have better have clear, undisputable evidence that the bins are NOT the property of WP. They “repossessed” mine today and I look forward to the new vendor providing me a new one as part of their $37,000,000 contract with the CoPC.

I didn’t have this problem from WP in nearly 20 yrs here, but when I got home yesterday is another story. FCC left my garbage can dead in the middle of my driveway.
