Today at the Editor’s Glance:
In Court: Felony court is not in session today. County and family courts are.
Notably: It is the anniversary of the Tulsa Race Massacre of 1921. Last year, Viola Fletcher, age 107, testified before Congress. “The night of the massacre, I was awakened by my family. My parents and five siblings were there. I was told we had to leave, and that was it. … I will never forget the violence of the white mob when we left our home,” she testified. “I still see Black men being shot, Black bodies lining the street. I still smell smoke and see fire. I still see Black businesses being burned. I still hear airplanes flying overhead. I hear the screams…. I have lived through the massacre every day. Our country may forget this history, but I cannot. I will not, and other survivors do not. And our descendants do not. … I am 107 years old and have never seen justice,” she continued. “I pray that one day I will. I have been blessed with a long life and have seen the best and the worst of this country. I think about the horror inflicted upon Black people in this country every day.”

The 13th Amendment, adopted after the Civil War, prohibits both slavery and “involuntary servitude.” What is forcing a woman to carry a pregnancy to term if not involuntary servitude? I claim no credit for this idea. Feminists invoked the 13th Amendment in a brief to the court during Roe v. Wade. And Andrew Koppelman, a law professor at Northwestern University, has been making the 13th Amendment argument as an originalist matter for years, drawing in part on the long history of enslaved women’s involuntary childbearing. Irin Carmon’s graphic description in New York magazine of the burdens of pregnancy, aimed at the Alito draft opinion’s obliviousness to women’s interests, has been making the rounds in feminist circles. While her essay, “I, Too, Have a Human Form,” does not make an explicit 13th Amendment argument, it could serve as Exhibit A in such a case. Anyone who offers a serious 13th Amendment argument risks being dismissed as a chaser of “fool’s gold,” as Professor Jamal Greene of Columbia Law School put it in a 2012 journal article, “Thirteenth Amendment Optimism.” So, yes, it’s a fantasy. But maybe the moment has come for fantasy, the reality of a modern nation without legal abortion having failed to move the current majority.

Jeff says
Criminals commit crimes with guns, not the guns.
Pierre Tristam says
So Americans must be pathologically predisposed to commit crimes with guns, since they alone among Western democracies so ably pull off these bloodbaths. Which would seem to be a much more serious issue.
Sherry says
@jeff. . . Please, for the love of humanity and democracy. . . STOP, “mindlessly” posting FOX “Cult” talking points!
The 18 year old who “MURDERED” 19 little school kids and two teachers in Texas with a military styled weapon of mass destruction was NOT a !@#$%^& criminal!
The 18 year old who “MURDERED” 10 in a supermarket in Buffalo, NY the week before with a military styled weapon of mass destruction was NOT a !@#$%^& criminal!
I could go on and on about other similar mass shootings. . . “NOT” committed by “criminals”. But, unfortunately, it is likely that “YOU” just may be so completely indoctrinated into the FOX alternate reality that you may not recognize actual facts when you see them. I sincerely hope not. . . and, I hope that there is a way back for you. Back to thinking for yourself, and back recognizing truth and facts.
Justin Case says
You seem to think people who disagree with you are indoctrinated into cults, and watch FOX News. That is judgmental and incorrect. A gun is an inanimate object. It does nothing until someone uses it. The overwhelming majority of gun owners are law abiding citizens. 18 year old people, (or any age) who commit crimes with guns are by definition criminals. They seem to be dealing with mental health issues. None of these shootings are because of a news network, or a manufacturing company. Place the blame where it belongs – on the shoulders of the criminals who commit the crimes.
Pierre Tristam says
So says the indoctrinated who watches NRA TV for his lullabies and reasons no differently than the old Jim Crowists who had their “Good Blacks” and their… well, you get the idea.
Sherry says
Unfortunately, Pierre, I don’t think ole’ Justin gets the idea at all. He has clearly relinquished his brain to the far right winged media outlets.
Sherry says
@jc. . . Don’t be so stupid as to play semantics with “rational thinking people”! I don’t really care precisely what in the world warped your mind to the point that you have lost your thinking ability. All you are doing is spouting extreme right winged outrageously ridiculous talking points amplified by the likes of despicable Ted Cruz!
* “Rational Thinking People” understand that mental illness is no more prevalent in the United States than other first world countries.
* “Rational Thinking People” know the “FACTS” that other countries have sharply reduced their mass shootings by more tightly regulating guns:
Other Countries Had Mass Shootings. Then They Changed Their Gun Laws. Britain, Australia, Canada, New Zealand, Norway: All had a culture of gun ownership, and all tightened restrictions anyway. Their violence statistics now diverge sharply from those of the U.S.
After a British gunman killed 16 people in 1987, the country banned semiautomatic weapons like those he had used. It did the same with most handguns after a 1996 school shooting. It now has one of the lowest gun-related death rates in the developed world.
In Australia, a 1996 massacre prompted mandatory gun buybacks that saw, according to some estimates, as many as one million firearms melted into slag. The rate of mass shootings plummeted from once every 18 months to, so far, only one in the 26 years since.
Canada also tightened gun laws after a 1989 mass shooting. So did Germany in 2002, New Zealand in 2019 and Norway last year.
* “Rational Thinking People” understand that often mass murders have been “indoctrinated” into lives filled with fear and hate which is blasted over social media, and right winged podcasts/TV and other media outlets.
* “Rational Thinking People” understand that the 18 year old NY and Texas shooters were “criminals” only AFTER THE FACT of their horrific murders!
* “Rational Thinking People” understand that those shooters had NO DIAGNOSIS of a mental disorder prior to their heinous MURDERS of completely innocent children and adults! Therefore no amount of increase treatment would have stopped them.
* “Rational Thinking People” understand that the constitution provides for “regulation” of gun ownership.
* “Rational Thinking People” understand that your statement about guns being inanimate objects is nothing short of spouting a ludicrous “talking point”. A nuclear bomb is also an inanimate object!
Unfortunately, you have demonstrated to us all that you are no longer a “rational thinking person”!
