Update: On Monday, the county attorney issued an updated proposed agreement that dropped Captain’s right of first use of the pavilion to just six holidays, not 18 weeks, while the restaurant would have to go through the usual county reservation system for the rest of the year.
A long-awaited proposed settlement agreement, the result of mediation between Flagler County government lawyers and Captain BBQ at Bing’s landing, goes before county commissioners Monday for their approval.
The settlement is remarkably generous to Captain’s, and in key parts even more generous than the controversial 2018 lease amendment the county eventually killed under pressure from a public backlash. If precedent is any indication in the Captain’s saga, nothing says commissioners’ agreement is assured, nor does it appear to have the county administrator’s backing.
“Because of the manner in which it addresses critical issues to the County, the final offer constitutes impasse in the mediation in the County Administrator’s judgment,” the administrative memo attached to the proposed settlement states.
Captain’s sued the county just over a year ago claiming breach of contract. Captain’s did so after commissioners reversed themselves after they’d agreed to a new lease with Captain’s in November 2018. That new lease would have allowed the restaurant to build a new, bigger structure closer to the middle of the popular park on the Intracoastal in the Hammock. Restaurant owners would have built it at their expense. But the larger footprint, the new location and generous county discounts on rent for the first five years, among other issues, triggered an angry backlash from Hammock residents and others and months of controversy and protests.
The commission rescinded the 2018 lease on June 3, 2019. Captain’s sued on June 7. The two sides participated in a mediation conference in February 2020. The county commission and its attorney discussed the mediation in a closed-door meeting on July 2, and County Administrator Jerry Cameron further negotiated with Captain’s representatives after that meeting.
“As a result of these efforts, the Parties have reached an agreement that will avoid the risk and expense of prolonged litigation,” the proposed settlement states.
The proposal calls for a series of commitments by the county and little in return from Captain’s other than running the restaurant, with exclusive rights on food sales at Bing’s and several other benefits.
The county’s commitment includes payment of up to $50,000 to reimburse Captain’s for the design and other costly work it did in advance of its previously planned building, assuming Captain’s can document the expenses.
The proposed agreement sets the new rent at at $1,500 a month starting in 2026, when the current lease, signed in 2011, expires, though the 2018 lease had foreseen a monthly rent of $4,000 starting in 2026 (it would have locked in a $1,000-a-month rent until then), with 3 percent annual increases. The proposed agreement sets forth nowhere near that kind of rent until 2041, and even then, it’ll be $3,500 a month.
The 2011 lease called for $500 a month rent, with increases of $40 a month at each annual anniversary, making today’s rent about $860 a month. (See the 2011 lease here.)
The proposed agreement allows four four five-year renewals of the lease, with rent rising to $1,750 a month in 2031, $2,500 five years later, and $3,500 by 2041. The proposal makes no provisions for inflation, no 3 percent a year adjustments.
Captain’s will be permitted to sell alcoholic drinks, and it will have exclusive rights to sell food at Bing’s, while Captain’s will have the right to sell or assign all its interests to a third party for the duration of the lease–without the county’s consent.
The county will also be repairing and renovating the existing building at its own expense through a top-down makeover: the county would be relocating and upgrading the bathroom, allowing Captain’s to install propane tanks at the south end of the building, enclosing the exterior patio (which in effect will enlarge the restaurant’s indoor dining area) and repair the heating and air system. The county will be exclusively responsible for maintaining Captain’s septic system, though it may also connect the business to a central sewer system in the future should that become available.
In future the county will be responsible for all repairs and maintenance of the building, including all replacement costs for foundations, wall sidings, the roof and so on. If the building is somehow destroyed, or more than half the structure loses its value because of a fire or a disaster, the county must rebuild it immediately, at its own expense, limiting business interruptions. Starting in 2026, the county will have to carry out all interior and exterior repairs that cost more than $2,000 and “periodically paint the exterior,” with Captain’s alerting the county to any needed repairs.
The 2018 lease had called for Captain’s to be solely responsible for maintenance of the new building it was to build, except for landscaping.
Before the 2018 controversy, Captain’s had frequently boasted of having itself spent some $300,000 “for improvements to the original location.”
The county would have to renovate the parking area and ensure that all parking spaces are preserved while maintaining the restaurant’s surrounding areas “consistent with its overall maintenance obligations of the park.”
Construction would begin within two weeks of the agreement’s approval. Captain’s during construction requiring closure of the building itself would get exclusive use of one of the pavilions in the park. Otherwise, the county would perform the work outside of business hours.
Captain’s will get additional perks: “Captain’s BBQ shall, at no cost, have the first right of priority to use the covered pavilion located south of the Existing Building for 18 weeks per year, beginning at 6:00 a.m. on Monday and ending at 9:00 p.m. on Sunday, and may, at no cost, have additional exclusive use of the pavilion for six holidays,” the agreement states, those periods being “the months of May, June, July, August and the first week of September as well as Memorial Day, July 4th, Labor Day, Easter, Mothers Date and Father’s Day.”
That doesn’t preclude members of the public from at least applying to use the pavilion during Captain’s time, but at that point, it’ll be Captain’s decision whether to allow the public to use it or not, in essence making Captain’s the de facto landlord of the pavilion for 18 weeks a year and those holidays. And if Captain’s does grant the use of the pavilion during the period when it controls it, then it will be credited additional days outside of that period.
The county commission holds an in-person meeting at the Government Services Building, 1769 East Moody Boulevard, Bunnell, Monday at 9 a.m. The proposed settlement agreement is on the agenda for the commission’s action.

#1 – There is a business at Bing’s that hires locals creating jobs and generating taxes. It’s not a new business but one that has been operating successfully for years.
#2 – What does ‘the County’ know about running a successful restaurant? Zero. Nada. Nothing.
#3 – The County should be responsible for the building and the grounds. If left to the lease holder they could let the building (a County asset) fall into disrepair or make changes (as in the parking area) that impact the park.
#4 regarding allowing Bing’s use of the Pavilion; hey they are generating more revenue and more tax money. Again, these folks know how to successfully operate a restaurant. Allowing them to use the Pavilion (which otherwise generates negative income for the County when considering it’s maintenance) is a good thing.
#5 – Regarding selling alcohol near a playground and ‘peaceful old trees’. Really? Check the coolers on the boats going in and out of the heavily used Park boat launch. And also check to see how many times the Sheriff has been called to the park. It’s not a law enforcement problem.
#6 – Regarding the opposition by folks from the Hammock; I’m sure that they would rather there not be a park and it’s associated traffic. What goes on behind your walls is your business. Please don’t treat Bing’s like it’s your backyard.

I drove by Bing’s Landing this afternoon and many trucks with empty boat trailers were parked alongside A1A. Looks to me like the County would have been better off getting rid of the dry meat joint and create more natural parking spaces for the citizens of Flagler County. This is our park and our pavilion to enjoy.
BTW I am not a boater, no self-interest here.
All that was needed from the owners was a contribution to the past election. Amen.

Once again thank you FlaglerLive.com for thoroughly explaining the most ((my opinion) , insane, legally insufficient proposed settlement which is a give away of taxpayer’s money and property. Captains violated their last lease agreement in 2018 by serving 30 more patrons than allowed by Health Department which was sufficient grounds to throw them out then!
I’m not done yet: Settlement merely says ” Alcoholic beverage” which means full liquor license which the county will have to apply for and assume responsibility for per State Liquor License law , not the lessee. The ‘proposed settlement’ omits this.
Just imagine any motor boat docking at the expensive floating docks ( we pay for) after having a few toooo many hard liquor aside from wine and beer which is currently allowed) – then take off into the intercoastal and kill or maim occupants of another boat)…

**The county cannot be indemnified from liability on any property owned by the county which is an illegal condition of all the leases ( Chair O’Brien is a licensed insurance expert- he should know this – so should Hadeed, especially since Mr. Hadeed has admitted to me personally the Flagler County paid an out of court settlement for a gentleman who filed suit because he fell at Captains, not Captains.. Hadeed’s answer to me ” we are trying to get that money ( around $40,000 if I recall correctly) back from Captain’s insurance carrier.

Apparently, the Florida government commissioners training received is inadequate. Though, several BOCC members continue “ self patting” themselves on the back in BOCC meetings.
The Hammock has endured two of these fiascos….projects with promised financial benefits never delivered to the County, but sellers cash in OR fiscal agreements signed that make absolutely no sense….not fair to competitors nearby or any other hospitality business.
BOCC officials get hoodwinked by sweet talking businessmen with resources and savvy far beyond their capabilities. The result ….County Administrator, Attorney are in a very compromised position. Don’t blame them…..they are trying to keep a very sizable bill from being ’out of control ‘ , with no end in sight .

We don’t live in Flagler county : we are up the road in St Johns which seems to have at least some common sense and decent business acumen. You folks down there are on the brink of holding the empty tax revenue bag if you allow this to pass, you money having gone to line the pockets of the BL operators who seem more than willing to fleece you locals as best they can, then sell the decrepit buildings and licenses they have to the next sucker and still turn a profit.
We have been there twice thinking (1) we would have lunch only to be disgusted with both menu and building and left, then (2) a month later swinging in to cocktail with friends only to find there was no bar or for that matter any decent selection to buy and take outside.
Nice part of the intracoastal waterway, probably best left as an open park until such time as a fair deal can be struck with more reputable investors with an eye for preserving the local ecology and ability to meet a fair lease agreement that is mutually agreeable.
Its worth the expense to Flagler to hire the right caliber of lawyer to show the current tenants the error of their ways and the door at the next possible moment, all in the same stroke of pen.

These commissioners voted and passed the lease that Coffey and Nate Mclouglin pushed when captains went for the new restaurant deal . Both my wife and I asked them not to approve it. I submitted to the board copies of the ordinal lease along with additional leases that Coffey was writing for captains with new concessions that put captains in the sweet heart position they have us in today. I tried to give copies of lease to mr Sullivan who voted in favor of the new deal , when I handed the leases to him I asked him if he had read leases and he said No , he refused to take the copies and told me he didn’t need to see it and dropped them back on the table .please remember this man is running for re-election this year .HE MUST GOOOO. The owners of Captains BBQ first bribed our Commisioners. Oops wait I meant to say genorously donated “campaign contributions” to the Commisioners that were seeking election. Once they bribed said commisioners, Oops I meant to say donated campaign funds the citizens of Flagler County stopped being represented. The BOCC then had to pay special favor to a selfish special interest. That has no concern for their neighborhood or county.
Did you all notice how most of this was kept in the dark? With numerous sunshine and ethics laws being violated. Then because the BOCC was bought by a special interest they had to make “special arrangements” to “take care of” our worthless county attorney Al Hadeed. I imagine he recieved financial gain as well.
Once our BOCC and “county attorney” were compromised they got themselves cornered into a shitty lease. And the owners of Captains BBQ laughed at Flagler County all the way to the bank. Once again the citizens of Flagler County becoming victims of corrupt politics.
It would be mighty interesting if we stood up for ourselves and had FDLE the Attorney General and FBI come in and investigate this whole matter. I have made a few phone calls requesting attention on this issue. But it takes a community to garner real interest.

These flight school planes are now flying until 12 midnight and throughout the daytime during a global pandemic! The only reason why they are voting no to this now is because voting time is just around the corner and they know that the taxpayers are pissed off, even still vote whomever you can out because once they are voted in again the SOS will continue, a leopard doesn’t change its spots. Its pretty embarrassing as a tax payer that this under handled deal set up a while back is allowing a business on county property to pay peanuts for an operation and screwing the tax payers all while smiling and collecting profit. Maybe this should end up in a real COURT of law. If this is good for this business what is preventing any other business on county property to expect the same or again, take it to court and ask for the same. The agreement that was reached allows the County to maintain control of the facility; both inside and out. And extending the lease to include the Pavilion generates additional tax revenue that can help maintain that structure.
The people of Flagler County have to stop being so short sighted and anti-anything. There is no income tax in Florida. Revenue needed to operate the County has to come from somewhere.

What Attorney Livingston has proposed for Michael Goodman is a cart blanche lease for Bings Landing. Please note that Michael Goodman’s name is not on the lease, his wife is. I hope every stipulation requested in this lease will be viewed very carefully. Mr. Hadeed you should be protecting Flagler County from people like the Goodman’s and their Attorney. This all goes back to Craig Coffey who along with you Mr. Hadeed, the past commissioners and our present commissioners that have put our county in this horrific financial mess along with a law suit regarding the latest lease signing that you agreed to and then tried to wiggle out of. Bings Landing originally was a bait, tackle, and barbecue, not a restaurant with a liquor license. Since the original signing of this lease it has mushroomed into a BIG financial asset to benefit the Goodman’s not the taxpayers of this county. Each and everyone of you are Tax Payers in this county. Why would you support any PART of this lease. We taxpayers should not be held responsible for the lawsuits made by The Goodman’s. You all personally should be held responsible, being the fact you made the decisions. I personally went before the board when this all took place when Graig Coffee was County Administrator,
asking you all not to pass the original lease. One reason was the very low $450. monthly rent and the bait, tackle and and barbecue grew into a restaurant. I spoke to deaf ears. My husband and I on another occasion, (before Mullins and O’Brien became commissioners) again asked you not to vote on the second lease. I spoke to deaf ears again. Commissioner Sullivan, after the meeting, you were asked by my husband if you read the lease, remember what you replied? No I did not. November is around the corner. Are you going to continue to allow Goodman to pay $500. Per month rent, along with ridiculously low rent increases, assuming ALL repairs and upgrades to the existing building, landscaping, parking, what ever the restaurant needs etc. that Goodman’s Attorney is DEMANDING. I ask you if you were the individual owning this restaurant and have a person leasing this restaurant would you give them a lease like this one and agree to all requests in this lease. Have you all checked into the amount of money Goodman is collecting monthly. He over the years with the $500. a month rent collected, has raped our county and you allowed this to happen. Think seriously when you all decide to vote. The rents should be starting at $4000. per month. Let your conscience be your guide.

Go find your on piece of property on the water and buy Captains !Problem solved !Seriously wanting county to maintain building that you are using that’s a bunch of BS !How about this move !How about local law enforcement or county control boat docking so people can unload and load boats because there is no spaces because of boaters eating inside captains !clearly has signs up but nobody is enforcing that hmm!Sad started out good but Greed got the best of them !MOVE!

The Captains Barbecue building was also a Community Center which people could rent for family events and businesses could rent it for their staff outings. I know because I rented it for my daughter’s graduation. So why can’t it be returned back to it’s former glory and build a really nice community center for all to use.
